Leaving a Bequest to Toorak College - Suggested Wording

If you would like to leave a gift in your Will to Toorak College, we have provided the following clauses for your consideration. It is recommended that you seek independent legal advice when drafting your Will.

You may make a specific bequest to Toorak College by either documenting the bequest directly within the Terms of your Will (if you make a new Will) or by way of a Codicil to be made in addition to (as an amendment) to your existing Will (A suggested form of Codicil is available on our website).

Bequest to specific purpose:

I GIVE [my whole estate] or [the residue of my estate] or [X% of the residue of my estate] or [the sum of $ ] to Toorak College of Old Mornington Road, Mount Eliza, Victoria for the purpose of (insert description of specific purpose – see examples below). I DECLARE that the receipt of the Treasurer or other authorised officer for the time being of Toorak College shall be a sufficient discharge to my trustees who shall not be responsible to see the application of the gift.

Unrestricted Bequest:

I GIVE [my whole estate] or [the residue of my estate] or [X% of the residue of my estate] or [the sum of $ ] to Toorak College of Old Mornington Road, Mount Eliza, Victoria. I DECLARE that the receipt of the Treasurer or other authorised officer for the time being of Toorak College shall be a sufficient discharge to my trustees who shall not be responsible to see the application of the gift.


Examples of descriptions of specific purpose:

- in the provision of [faculty eg. music, art, science] tuition and programmes and the provision of associated resources including, but not limited to, equipment and dedicated buildings

- for the development of sporting facilities or to be applied towards sporting pursuits by students

- the development, replacement or maintenance of the School buildings and grounds

- towards the provision of the Hamilton Society Scholarship
